Terms and Conditions
These are the rules for using the AirCal service, sensors, and data.
1. Agreement to Terms
By accessing our website, connecting a sensor, or using our services (collectively, the "Services"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you may not access or use our Services.
2. User Accounts
To use certain features of our Service, you may be required to create an account. You must be at least 18 years old or the age of legal majority in your jurisdiction. You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to provide us with accurate, complete, and current information for your account, especially the location for your sensor installation, as this is critical to the integrity of our data network.
3. Sensor Data and Data License
You retain ownership of the raw data generated by your specific sensor. However, to provide our Services and fulfill our open data mission, you must grant us certain rights to that data.
By connecting your sensor to the AirCal network, you grant AirCal a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sub-licensable license to use, copy, modify, aggregate, display, publish, and distribute the environmental and location data generated by your sensor in any and all media or distribution methods (now known or later developed).
This license is granted for the express purposes of operating and improving the Service, powering the public air quality map, training our AI compensation models, creating aggregated and anonymized data products, and sharing data with the public, researchers, and other organizations via our open data API.
4. Open Source Components
Hardware
The hardware designs for AirCal sensors are made available under an open-source license (e.g., CERN Open Hardware Licence). These Terms of Service apply to the AirCal data service, not the hardware itself. We disclaim all liability for any hardware you build, modify, or use based on our open-source plans. Your use of the open-source designs is subject to the terms of the applicable open-source license.
Data
The aggregated, anonymized public data made available through our public map and API is provided under the Creative Commons Attribution 4.0 International (CC BY 4.0) license, unless otherwise specified. You are free to share and adapt the public data for any purpose, even commercially, as long as you give appropriate credit.
5. Acceptable Use
You agree not to misuse the Services. For example, you must not:
- Attempt to reverse-engineer, decompile, or otherwise access the source code of our proprietary software or AI models.
- Send false, malicious, spoofed, or otherwise corrupted data to the AirCal network.
- Use the Services for any illegal or unauthorized purpose.
- Scrape our website or data in a manner that is not in accordance with the intended use of our open API.
- Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
6. Disclaimers and No Warranties
The service is provided 'as is' and 'as available' without any warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
AirCal data is for informational purposes only. It is not intended for medical, safety, or emergency use. Do not make health decisions, financial decisions, or any other critical decisions based solely on data from the AirCal network. You should consult with qualified professionals for any medical or safety concerns.
We do not guarantee the accuracy, completeness, or reliability of any data on our network, especially data generated by other users' sensors. The AI-compensation is a statistical model and may contain errors. You acknowledge that you use and rely on the data at your own risk.
7. Limitation of Liability
To the fullest extent permitted by law, in no event shall AirCal, its founders, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content or data obtained from the services; or (d) unauthorized access, use, or alteration of your transmissions or content.
8. Termination
We may suspend or terminate your access to our Services at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. You can also terminate this agreement at any time by deleting your account and ceasing to use the Services. Upon termination, your license to us for your sensor data (Section 3) remains in effect.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in Mumbai, India.
10. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. We will notify you of any changes by posting the new Terms on this page.
